Terms of Service
Last updated: August 28, 2026Welcome to Poker Panel. These Terms of Service ("Terms") govern your use of the Poker Panel macOS application, the Poker Panel Windows application, the Poker Panel iOS application, the pokerpanel.app website, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
Poker Panel is operated by Henry Schlesinger, sole proprietor ("Poker Panel," "we," "our," or "us").
1. Eligibility
You must be at least 18 years of age to use the Service. Poker Panel is poker-related software designed for adult users. By creating an account or using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
2. Account and License
When you subscribe to Poker Panel, you receive a non-exclusive, non-transferable, revocable license to use the software. What that license covers depends on your plan.
2.1 Home Game and Game Night — private and home games
- Licensed for private and home poker games: games you host that are not operated as a business.
- This includes streaming those games publicly and earning revenue from the stream — advertising, subscriptions, sponsorships or tips. Making money from your broadcast does not require a Card Room plan.
- Your license is per-user. You may not share, sublicense, or transfer your license key or account credentials to any other person.
- Your license covers the devices you personally use to run your own games. We do not cap the number of devices, but the licence remains per-user: it is for one person's games, not for distribution to others.
2.2 Card Room — commercial venues
- A Card Room plan is required to use the Service at a commercial poker venue: a business that operates poker games for profit, whether through rake, time collection, table fees, membership or admission. This includes card rooms, casinos, clubs and poker rooms operated as part of another business.
- The distinction is how the game is operated, not whether the broadcast earns money. A private host with a monetized stream does not need this plan; a business that takes a rake does, even if it never streams.
- A Card Room license covers one venue at one physical location, and may be used on the devices that venue needs to run its own tables. It may not be shared between separate venues or businesses under common ownership; each location requires its own subscription.
- The number of simultaneous broadcasts remains subject to the technical capabilities of the Service.
- Your Card Room license does not transfer if the venue is sold or its ownership changes. Contact us to reassign it.
2.3 Responsibility for your games
You are solely responsible for ensuring that the poker games you operate, host or broadcast comply with all laws, licensing requirements and regulations that apply to you and to your location. Poker Panel is software for producing a broadcast; it is not gaming, legal or compliance advice, and subscribing to any plan is not a representation by us that your games are lawful.
3. Subscription Plans and Billing
- Game Night pass: $20 for a single 48-hour period, which starts at your first sign-in. One-time charge, does not renew.
- Home Game Plan: $59 per month, or $590 per year.
- Card Room Plan: $299 per month, or $3,000 per year ($250 per month, billed annually).
Recurring subscriptions are billed monthly or annually, according to the plan and billing period you select at checkout, through Stripe, our payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis for the billing period you selected, until you cancel. You can cancel your subscription at any time; your access will continue until the end of the current billing period.
Prices are subject to change with 30 days' notice. Any price changes will not affect your current billing period.
4. Refund Policy
We offer a full refund within 14 days of your initial purchase of a Home Game or Card Room subscription, no questions asked. To request a refund, contact us at henry@pokerpanel.app. Refunds are processed back to your original payment method via Stripe and may take 5–10 business days to appear on your statement.
The Game Night pass is refundable only before it is used. Because the pass is a single 48-hour window that begins at your first sign-in, a used pass has been fully delivered and cannot be refunded. If you bought a pass and never signed in, contact us and we will refund it.
Renewals are not automatically refundable. If a renewal charge catches you by surprise, contact us within 14 days of the charge and we will look at it — see Automatic Renewal and Cancellation for how to turn renewal off before it happens.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the software
- Modify, adapt, translate, or create derivative works based on the software
- Share, resell, redistribute, sublicense, or otherwise transfer your license to any third party
- Circumvent, disable, or interfere with any license verification or security features of the software
- Use the Service to facilitate any form of illegal gambling
- Use automated tools to access or interact with the Service in an unauthorized manner
6. License Revocation
We reserve the right to suspend or revoke your license at any time if you violate these Terms, including but not limited to: sharing your license key or account credentials with another person, using a Home Game or Game Night licence at a commercial venue, circumventing license verification, or engaging in any prohibited activity. In the event of revocation for cause, you will not be entitled to a refund for the current billing period.
7. Intellectual Property
The Service, including the Poker Panel software, CardEYE vision model, all graphics, logos, trademarks, and content, is the exclusive property of Poker Panel and is protected by applicable intellectual property laws. Your subscription grants you a limited license to use the software - it does not transfer any ownership rights to you.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
- The software will meet your specific requirements or expectations
- The software will operate without interruption, errors, or defects
- Card detection results will be 100% accurate at all times
- The software will produce any specific results, including streaming quality, viewer engagement, or other outcomes
9. Limitation of Liability
To the maximum extent permitted by law, Poker Panel and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service, regardless of the cause of action or the theory of liability.
Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms limits or excludes liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, or death or personal injury caused by negligence, or any other liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you; in that case our liability is limited to the maximum extent permitted by law.
10. Automatic Renewal and Cancellation
Subscriptions renew automatically. Unless you cancel, your Home Game or Card Room subscription renews at the end of each billing period — monthly plans every month, annual plans every year — and your payment method is charged the then-current price for that plan automatically, until you cancel. The Game Night pass is a one-time charge and never renews.
You can cancel at any time, yourself, without contacting us. Open Poker Panel, go to your account, and choose Manage Subscription. That opens the Stripe billing portal, where you can cancel, change your payment method, and view invoices. Cancellation takes effect at the end of the billing period you have already paid for; you keep access until then and are not charged again.
If you cannot reach the billing portal for any reason, email henry@pokerpanel.app and we will cancel it for you. We will never require you to call, chat, or negotiate to cancel.
We will email you a reminder before any annual renewal, to the address on your account.
11. Your Responsibility and Indemnification
You are responsible for what you produce, broadcast, record, and publish with the Service, and for everyone who appears in it. In particular you are responsible for obtaining any consent, release, or permission required from the players and other people who appear on camera, whose names you enter, whose photographs you capture, or whose results you publish.
You agree to indemnify, defend, and hold harmless Poker Panel and its owner from any third-party claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your broadcasts, recordings, or published content; (b) the operation or legality of the poker games you host, including any gaming, licensing, or gambling law that applies to you; (c) any person appearing in your broadcast, including claims about their name, likeness, image, or personal data; (d) your breach of these Terms; or (e) your infringement of anyone's intellectual property or privacy rights.
This section survives termination of your subscription. It does not apply to claims arising from our own gross negligence or willful misconduct.
12. Privacy
Your use of the Service is also governed by the Privacy Policy below, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.
13. Third-Party Services
The Service integrates with third-party services including Stripe (payment processing), Apple (app distribution), Google Cloud Platform (account infrastructure and the media relay that carries wireless camera video), Cloudflare (website hosting, content delivery, and the control relay that carries pairing and panel traffic), Sentry (crash and error reporting), and the streaming platforms you choose to broadcast to, such as YouTube, Twitch or Kick. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.
14. Modifications to the Service
We reserve the right to modify, update, or discontinue the Service (or any part thereof) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the application. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and by applicable United States federal law. Subject to the arbitration section below, any dispute that proceeds in court shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you and we each consent to the personal jurisdiction of those courts. If you are a consumer resident in a jurisdiction whose law gives you the right to bring proceedings locally, or grants you protections that cannot be waived by agreement, nothing here removes that right.
17. Dispute Resolution and Arbitration
Talk to us first. Most problems are settled by email. Before starting arbitration or a lawsuit, send a written description of the dispute and the resolution you want to henry@pokerpanel.app, and give us 30 days to resolve it.
Binding individual arbitration. If we cannot resolve it, you and we agree that any dispute arising out of or relating to these Terms or the Service will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in Travis County, Texas, or by videoconference, or in your home county if you prefer. Judgment on the award may be entered in any court with jurisdiction.
Class action waiver. Claims must be brought individually. You and we each waive any right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, and the rest of this section still applies.
Small claims carve-out. Either of us may bring an individual claim in small claims court instead, if it qualifies. Either of us may also seek injunctive relief in court to protect intellectual property or stop unauthorized use of the Service.
You can opt out. If you do not want to be bound by this arbitration section, email henry@pokerpanel.app with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out costs you nothing and does not affect your subscription or any other part of these Terms.
This section survives termination of your subscription.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
19. Contact
If you have questions about these Terms of Service, contact us at henry@pokerpanel.app.
Privacy Policy
Last updated: August 28, 2026 · Effective: August 28, 2026Poker Panel is operated by Henry Schlesinger, sole proprietor, based in the United States ("Poker Panel," "we," "our," or "us"). We operate the Poker Panel macOS application, the Poker Panel Windows application, the Poker Panel iOS application, and the pokerpanel.app website (collectively, the "Service"). This policy describes how we collect, use, store, and protect your information.
1. Information We Collect
Account & Billing Information. When you purchase a subscription, we collect your name, email address, and payment information. Payment processing is handled securely by Stripe - we never store your full credit card number, CVV, or bank details on our servers.
Camera and Video Data. The Poker Panel iOS app accesses your iPhone's camera to send video to the Poker Panel desktop application. How that video travels depends on how you connect the camera:
- Wired, or on your local network. Video passes directly between your own devices over USB or your local Wi-Fi and never reaches us.
- Wireless cameras. Video is carried over an encrypted connection through our media relay servers, hosted on Google Cloud Platform in the United States, which forward it to your computer in real time. The relay is a pass-through: video is not recorded, written to disk, or retained by us, and we do not watch it. It exists on the relay only for the moments it is in flight.
We never receive your finished broadcast. That is encoded on your own computer and sent straight to whichever streaming platform you have configured.
Local Network and Pairing. The iOS app uses your local network (Wi-Fi) and Bluetooth to discover and pair with the Poker Panel desktop application. Local discovery over Bonjour/mDNS and Bluetooth pairing stay on your own devices. Pairing codes and the control-panel connection are brokered by our relay so that a phone can reach your computer when the two are not on the same network; that connection carries game and control data, not your video.
Card Detection Data. The CardEYE vision model runs entirely on your own computer. Card detection is processed locally, and card images are not uploaded to us. If you explicitly send us a sample image while reporting a detection problem, that is the only circumstance in which one leaves your machine.
Crash and Error Reports. When the application crashes or hits an error, we collect a diagnostic report through Sentry, our error-reporting provider. This includes the app version, your operating system version, technical details of the fault, and the email address of the signed-in account, so that we can identify and fix a problem affecting you specifically. We use these reports to diagnose and fix defects, not to build a profile of how you use the software. Apple additionally provides aggregate, anonymised crash statistics for App Store distribution.
Game and Player Data. If you use player statistics, or issue a Developer API key for your venue, the hands played at your table and the player records you have created — names, seat results, derived statistics, and any player photograph or avatar you capture or upload — are stored on our infrastructure so they remain available when your computer is off. Hole cards are never published live; hand histories include only cards shown at showdown. You control which players appear, under what name, and with what image, and you can ask us to delete this data at any time. If you do not use these features, hands stay on your own machine.
People who appear in your broadcast. The players at your table are not our customers and have no account with us, but their names, results, and photographs may end up in the records above. For that data you are the controller and we are your processor: it is entered by you, displayed under your control, and handled by us only to run the Service for you. You are responsible for having whatever consent or notice the law where you operate requires before you enter a person's name, capture their photograph, or broadcast their play — see the indemnification section of the Terms of Service.
If you are a player rather than a customer and you want to know what is held about you, corrected, or deleted, contact us at henry@pokerpanel.app. We will identify the venue or host holding your records and pass the request to them, and we will act on it directly where the law requires us to. Facial images are never used to identify or match a person: we do not run face recognition, we do not generate faceprints or other biometric identifiers, and the card-detection model does not look at faces.
Software Updates. The Poker Panel macOS application periodically checks our servers for available updates. This request transmits your app version and your device's IP address. We do not retain IP addresses from update checks in our own records, though our content delivery provider processes them transiently to serve the request and protect the service from abuse.
Website Analytics. Our website uses Google Analytics 4 to understand how visitors find and move through the site: page views, referrer URLs, browser and device type, and approximate geographic location at the country or region level. Google Analytics sets cookies in your browser. We have not enabled Google Signals, advertising features, or remarketing, and we do not use the data for advertising. See Google's Privacy Policy. Our website is served by Cloudflare, which processes request data such as your IP address to deliver the site and protect it from abuse.
2. Legal Basis for Processing (GDPR)
If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, we process your personal data on the following legal bases:
- Contract performance - Processing your account and subscription data is necessary to provide you with the Service you have purchased.
- Legitimate interest - We process anonymized analytics data to improve our software and diagnose issues. We have assessed that this processing does not override your privacy rights given the data is non-identifying.
- Consent - Where we ask for it directly, such as when you choose to send us a diagnostic sample while reporting a problem.
- Legal obligation - We may process data where required to comply with applicable laws.
3. How We Use Your Information
- To provide, operate, and maintain the Poker Panel service
- To process your subscription and manage your account
- To send you important updates about the software (e.g., version updates, security notices, billing changes)
- To provide customer support
- To analyze aggregated, anonymized usage data to improve our products
- To check for and deliver software updates
- To comply with legal obligations
4. Cookies and Tracking Technologies
Our website uses a small number of cookies. Specifically:
- Google Analytics 4 - Sets first-party cookies to measure page views and distinguish repeat visits from new ones. Used for audience measurement only; advertising and remarketing features are switched off.
- Cloudflare - May set a cookie to keep the site available and to distinguish legitimate visitors from automated abuse.
- Local Storage - Our website may use your browser's local storage to remember interface preferences. This data stays in your browser and is never sent to our servers.
We do not use any advertising trackers, remarketing pixels, or fingerprinting technologies, and we do not sell or share this data. You can block or delete these cookies in your browser without losing access to any part of the site.
Do Not Track. Some browsers offer a "Do Not Track" (DNT) setting. Because there is no widely accepted standard for how to respond to DNT signals, our website does not currently respond to them. However, we do not engage in cross-site tracking regardless of your DNT setting.
5. Data Storage and Security
Your account and subscription data are stored securely using Google Cloud Platform (United States region) with encryption at rest and in transit. Video feeds and card detection run on your own devices. Where you have turned on player statistics or the Developer API, the hand and player records described above are stored on our infrastructure under the same protections.
We implement industry-standard security measures including TLS encryption for all data in transit, encrypted storage at rest, and access controls limiting data access to essential personnel only.
6. Data Retention
- Account data - Retained for the duration of your active subscription, plus 30 days after account deletion.
- Billing records - Retained for up to 7 years after your last transaction as required for tax and legal compliance. Stripe may independently retain payment data per their privacy policy.
- Analytics data - Aggregated and anonymized; retained indefinitely as it cannot be linked to any individual.
- Support correspondence - Retained for up to 2 years after the last interaction for quality and reference purposes.
7. Third-Party Services and Data Sharing
We share data only with the following service providers, strictly as necessary to operate the Service:
- Stripe - Payment processing. See Stripe's Privacy Policy.
- Google Cloud Platform - Account data infrastructure, and the media relay that carries wireless camera video in transit between your phone and your computer. See Google Cloud Privacy Notice.
- Apple - App distribution and crash analytics via the App Store. See Apple's Privacy Policy.
- Cloudflare - Website hosting, content delivery, and the control relay that carries pairing and control-panel traffic between your devices. Cloudflare does not carry your camera video. See Cloudflare's Privacy Policy.
- Sentry - Crash and error reporting from the applications. See Sentry's Privacy Policy.
- Google - Website analytics and account sign-in. See Google's Privacy Policy.
We do not sell, rent, or share your personal information with third parties for marketing or advertising purposes. We will never sell your data. We do not share your personal data with any parties beyond those listed above, except:
- When required by law, including in response to a court order, subpoena, government investigation, or other legal process.
- When we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.
- In connection with a merger, acquisition, or sale of all or a portion of our assets - in which case you will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your personal information, as well as any choices you may have.
8. International Data Transfers
Our servers and service providers are located in the United States. If you access the Service from outside the United States, your data will be transferred to and processed in the United States, where data protection laws may differ from those in your country. By using the Service, you consent to this transfer. For EEA/UK users, these transfers are conducted under Standard Contractual Clauses (SCCs) where applicable.
9. Your Rights
Depending on your location, you may have the following rights regarding your personal data:
- Access - Request a copy of the personal data we hold about you.
- Correction - Request correction of inaccurate or incomplete data.
- Deletion - Request deletion of your personal data. If you delete your account, we will remove your personal data from our systems within 30 days (except data we are legally required to retain).
- Portability - Request your data in a structured, machine-readable format (EEA/UK users).
- Restriction - Request that we restrict processing of your data in certain circumstances (EEA/UK users).
- Objection - Object to processing based on legitimate interest (EEA/UK users).
- Withdraw consent - Where processing is based on consent, you may withdraw it at any time.
To exercise any of these rights, contact us at henry@pokerpanel.app. We will respond to your request without undue delay and in any event within one month of receipt.
10. Your California Privacy Rights (CCPA/CPRA)
If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) provide you with additional rights:
- Right to Know - You may request details about the categories of personal information we collect, the purposes for collection, and the categories of third parties with whom we share it.
- Right to Delete - You may request deletion of your personal information, subject to certain exceptions.
- Right to Correct - You may request correction of inaccurate personal information that we maintain about you.
- Right to Opt-Out - We do not sell or share your personal information for cross-context behavioral advertising. There is no need to opt out because we do not engage in these practices.
- Right to Non-Discrimination - We will not discriminate against you for exercising your CCPA/CPRA rights.
To submit a request, contact us at henry@pokerpanel.app.
11. Children's Privacy
Poker Panel is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a child under 18, we will promptly delete that information.
12. Changes to This Policy
We may update this policy from time to time. We will notify you of material changes via the email address associated with your account or through a prominent notice in the application at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated policy.
13. Supervisory Authority (EEA/UK)
If you are located in the EEA or UK and believe that our processing of your personal data violates applicable data protection law, you have the right to lodge a complaint with your local data protection supervisory authority.
14. Governing Law
This Privacy Policy is governed by the laws of the State of Texas and applicable United States federal law, and disputes are handled as set out in the Dispute Resolution and Arbitration section of the Terms of Service. Nothing here removes a right you have under the data protection law of your own country, including your right to complain to your local supervisory authority.
